Orfyn is a product of Thinqmesh Technologies. These terms govern your use of the Orfyn website and the Orfyn software. By using either, you agree to them. If you are agreeing on behalf of an organisation, you confirm you have authority to bind it, and "you" means that organisation.
1. What Orfyn is
Orfyn is self-hosted software. You install and operate a daemon on infrastructure you control. The daemon launches and supervises agent command-line tools that you have installed and authenticated, and it operates on files and systems reachable from that machine.
We do not host your workloads. We do not execute your agents, hold your source code, proxy your model calls, or operate a multi-tenant service containing your data.
2. Licence to the software
The software is proprietary and is licensed, not sold. It is distributed under the PolyForm Internal Use License 1.0.0, which accompanies the distribution and governs your rights in the software itself. Where that licence and these terms conflict in respect of the software, the licence prevails.
In summary, and without replacing the licence text: you may use, modify, and run the software for your own internal business purposes. You may not provide it to third parties as a service, redistribute it, or offer it commercially. Source availability is not a grant of open-source rights.
Nothing in that licence restricts what you build with the software. Your code, your configurations, and anything agents produce on your infrastructure remain entirely yours.
3. Your responsibilities
You are responsible for:
- The host. Operating, securing, patching, and monitoring the machine the daemon runs on, and controlling network access to it.
- Credentials. Obtaining, securing, and rotating the model-provider and system credentials the daemon uses. You are responsible for activity performed with them.
- Authorisation. Ensuring you have the right to let agents access every system, repository, and dataset you point them at.
- Review. Reviewing what agents propose before it reaches production. The software is designed to deliver changes as reviewable proposals; whether you review them is your decision and your risk.
- Compliance. Your use of the software under laws and regulations that apply to you, including data protection, export control, and sector-specific rules.
- Capacity. Sizing storage, compute, and network for parallel agent workloads.
4. Third-party services
The software runs agent CLIs and connects to model providers that you choose and configure. Those are third-party services governed by your agreement with them, including their terms on data use and training. We are not a party to that relationship, do not control those services, and are not responsible for their availability, output, pricing, or handling of your data.
5. Acceptable use
Your use must comply with acceptable-use.md, which forms part of
these terms.
6. The relay (optional)
If you use the relay to connect a client to your daemon over the internet, it is provided "as is" and without an availability commitment. Traffic is end-to-end encrypted and the relay transports ciphertext it cannot read. You may decline the relay entirely and connect directly over your own network.
We may rate-limit, suspend, or terminate relay access to protect the service or other users, or where use breaches these terms.
7. Website content
Website content is provided for information. It is not a warranty, a specification, or an offer. Illustrative examples are labelled as illustrative and do not describe a specific customer engagement.
8. Feedback
If you send us suggestions, we may use them without restriction or obligation. You do not transfer any of your confidential information or intellectual property by doing so, and you should not send us confidential information in feedback.
9. Intellectual property
We retain all rights in the Orfyn name, logo, and website content, other than rights granted by the software licence. You retain all rights in your code, data, configurations, and anything agents produce on your infrastructure. We acquire no rights in your work.
10. Disclaimers
To the fullest extent permitted by law, the software and website are provided "as is", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing.
Agent output requires review. The software directs language models, which can produce incorrect, incomplete, or unsafe output. It is designed so that changes arrive as proposals for a human to review. We do not warrant that any output is correct, complete, secure, or fit for your purpose, and you must not deploy output to production without review appropriate to its blast radius.
11. Limitation of liability
To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunity, however caused.
Our total aggregate liability arising out of or relating to these terms is limited to the greater of the amounts you paid us in the twelve months preceding the claim, or INR 10,000 (ten thousand rupees).
Nothing here limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be limited.
12. Indemnity
You will indemnify us against third-party claims arising from your use of the software in breach of these terms, your violation of law, or your infringement of a third party's rights — including claims arising from systems or data you directed agents to access without authorisation.
13. Term and termination
These terms apply while you use the website or software. You may stop at any time. We may suspend or terminate access to the website and the relay for breach. Sections 8 through 12, and any provision that by its nature should survive, survive termination.
Because the software runs on your infrastructure, termination of these terms does not delete anything on your machines.
14. Changes
We may update these terms. The current version is always here with its effective date. Where a change is material we will take reasonable steps to notify you. Continued use after the effective date means you accept the change.
15. Governing law
These terms are governed by the laws of India, without regard to conflict-of-laws rules.
Dispute resolution. The parties will first attempt to resolve any dispute in good faith within 30 days of written notice. Failing that, the dispute will be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator appointed by mutual agreement. The seat and venue of arbitration is Noida, Uttar Pradesh, and the language is English. The award is final and binding.
Subject to the above, the courts at Gautam Budh Nagar, Uttar Pradesh have exclusive jurisdiction, including for interim relief. Nothing in this clause prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction.
16. Compliance with Indian law
We operate from India and comply with applicable Indian law, including the Information Technology Act, 2000 and rules made under it, and the Digital Personal Data Protection Act, 2023. Details of our data-handling practices are in the Privacy Policy.
17. Enterprise enquiries
Orfyn is deployed into enterprise environments where the specifics — architecture, integration surface, controls, and commercial terms — depend on your environment. Detailed technical, security, and commercial documentation is provided directly on request, under NDA where appropriate. Contact support@thinqmesh.com or request a meeting through the website.
Nothing on the website constitutes an offer capable of acceptance, a specification, or a commitment to deliver any particular functionality.
18. General
These terms, together with the acceptable use policy and any executed data processing addendum, are the entire agreement between us on this subject. If a provision is unenforceable, the rest stands. Failure to enforce a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them to a successor in connection with a merger, acquisition, or sale of assets.
